Specific Terms & Conditions (Website Service)

 

Conditions for using Website Service: the member has acknowledged, agreed, and consented to comply with the General Terms and Conditions for using the Products and Services General Terms and Conditions) of Ready Planet Co., Ltd. as specified in URL  https://terms.readyplanet.com/15856245/general-terms-and-conditions and the terms and conditions for using individually specific products and services as follows:

1. Service

1.1 Website Service is the Product and Service the Company has designed and developed the Template Program and Website Creation and Management System (including the website’s element design) in order that the member who wishes to use this type of the Products and Services can use the Website Service provided by the member to the Company to be mutually designed with the Company and the member can input information, picture, and contents through the Website Creation and Management System of www.ReadyPlanet.com


1.2 The Company reserves the copyright and/or any right under the law in the Template Program and Website Creation and Management System (including the website’s element design) used for providing the Website Service. Any person is prohibited to copy, reproduce, improve, develop, and/or use (whether for commercial purpose or not) without prior written approval of the Company.

1.3 The Template Program and Website Creation and Management System (including the website’s element design) is the work correctly created and developed under the copyright of the Company, the Company therefore reserves the right to show the word “ReadyPlanet Engine” at the above right corner and the word “powered by ReadyPlanet” at the bottom of the member’s Website Service. If the member wishes to change the condition in this part to be appropriate with the style of its Website Service, the member shall contact and notify the Company its intention in advance before operating the said action.

1.4 The Company has no policy to allow the member uploading files, programs, as well as html files created by web writing programs on the member’s Website Service. Sending information to show on the member’s Website Service shall be made only by using an internet browser to send pictures and texts into the member’s Website Service at the required position in accordance with the method of use of the management system for the member’s Website Service only.

1.5 The Company has no policy to arrange a program for using the Website Service or to specifically make a website in the type of Tailor Made to any of the members because to make a specific website spending high expense. The Company aims for develop the website creation system with variety and flexibility in favour of all members in main. If any member has its opinion or any advice in this regard, the Company is pleased to hear such opinion or advices from all members for further improvement and development.

1.6 In the event where the Company has made a specific program to any member, the Company shall develop the program into the standard system of www.ReadyPlanet.com and it may incur or not incur expense, depending on the agreement of the Company and the member. However, the Company reserves the right to provide the service of the program made and developed to other members and the said program made and developed shall be deemed as the Company’s sole right and property. If the member has ceased the service of www.ReadyPlanet.com, the member can no more use such program.

1.7 The member shall annually pay the domain name registration fee and system service fee for the member’s Website Service (including renewal fee for next year and the said expenses shall be notified by the Company to the member before using the Products and Services on the Website Service.

1.8 The member acknowledges that the Company has provided the Website Service design service with the CoolStart which is a specific design for each member’s Website Service under the website program of www.ReadyPlanet.com. In such case, the Company reserves the right to provide other members in the same or similar business the Website Service by designing the Website Service which is different as the Company thinks it is appropriate.

1.9 Time the Company has spent to provide the Website Service design service with the CoolStart to the member shall be from the date of which the Company has received complete information, which is sufficient for designing the Website Service from the member only.

 

2. Domain name

2.1 The member acknowledges that the domain name or the Website Service which has been registered shall not be changed its name or shall not be refundable. If the member wishes to change the name of its Website Service, the member shall register a new domain name and move the information from its previous Website Service in accordance with the Service Conditions specified by the Company only.

2.2 The member acknowledges, understands, agrees, and accepts the terms and condition on domain name service of all foreign service providers who provide the service relating to its Website Service, including but not limited to eNom Registration Agreement and Uniform Domain Name Dispute Resolution Policy. In such case, the member can access and study the details of the said terms and condition on domain name service at http://www.enom.com/terms.

 

3. Renewal and Cancellation of the Service

3.1 The member has the duty to renew the domain name and the member’s Website Service itself and the member can know the date of expiration of the member’s domain name and Website Service by logging on and checking the management system of the member’s Website Service and notifying the Company its intention to renew the said time duration thereof at least 7 days in advance before the expiration. However, even if the Company shall facilitate its member in advance warning the member prior to the expiry date via email and/or telephone, the member remains responsible for renewal of the domain name and the member’s Website Service by the member whether the member will be warned by the Company or not.

3.2 In the event where the member wishes to request the Company to renew the domain name and the member’s Website Service which were expired, the Company is glad to assist for such execution. However, the Company is unable to assure the success of such execution as such execution depends on the international renewal condition of the domain name. In the event where expense which must be paid to the foreign Service Provider incurs such execution, the member must be solely and entirely responsible for that part of expense.

3.3 Upon the member’s cancellation of service usage and the member’s Website Service, the member can no more access into its Website Service and the Website Management System. In addition, the member acknowledges and accepts that the Company shall delete all information in the Website Service of the member according to the Company’s deleting period. The member has the duty to save information in its Website Service into the member’s other own storage sources. In such case, the Company is irresponsible for any loss and/or damage of the information deleted by the Company.

 

4. System

4.1 The member has the duty to save information pictures and contents shown in the Website Service into the member’s other own storage sources so that the member can also enter the original of the saved information in the management system of the new member’s Website Service in the event of serious damage to the information shown in the page of the member’s Website Service.

4.2 The Company has provided the backup system of information shown in the Website Service of the member in accordance with the standard of the Company. In the event where any serious damage to the information shown in the Website Service of the member, the Company may restore information backup by the Company and the said information is only the last backup from the system even if the Service Provider has continuously improved and developed it in order to keep and restore it proficiently. However, the Company has not guaranteed information loss and/or damage arisen in the event where the stored information is lost at any case.

4.3 As the current email system is a system which can support the information which is big and changed all the time, the member can use email program, such as Outlook, to retrieve information shown in the page of the member’s Website Service to be stored at personal computer. The Company has advised that the member shall regularly use such email program for retrieving the information from Mail Server to be at personal computer. The member has acknowledged that the Company has not provided information backup system for the member’s email information, and the Company is unable to guarantee the loss of the email information stored at Mail Server and/or any damage arisen under no circumstances.
